🍞 Homebaked Terms & Conditions (for Consumers)

Welcome to Homebaked! These Terms & Conditions ("Terms") apply to your use of the Homebaked mobile app and website ("Platform") as a buyer of goods. By using Homebaked, you agree to these Terms — please read them carefully.

1. About Homebaked

Homebaked is a marketplace that connects local bakers with people who want to buy homemade baked goods. We don't bake the goods ourselves, and we don't supervise or control the bakers. We just give them a platform to share their creations.

2. Who Can Use Homebaked

You must be at least 18 years old to place an order. By using Homebaked, you confirm that:

  • You are legally able to enter into a binding contract,
  • You will use the platform for personal, non-commercial purposes,
  • You'll provide accurate information when signing up or placing orders.

3. Placing Orders

When you place an order, you're entering into a direct agreement with the baker. Bakers are responsible for:

  • Preparing and packaging the food,
  • Setting and displaying pricing,
  • Managing pickup or delivery logistics.

Once your order is confirmed, changes or cancellations are at the discretion of the baker.

4. Food Safety

Homebaked does not inspect or certify kitchens. Bakers are responsible for following local laws and regulations — including cottage food laws, health permits, and food labeling requirements.

By using Homebaked, you acknowledge:

  • You are purchasing homemade food that may not be prepared in a commercial kitchen.
  • You are responsible for reviewing item descriptions and asking bakers about allergens or ingredients.

5. Payments

All payments are processed securely through our third-party provider (Stripe).

We do not store your full payment information.

6. Refunds & Disputes

If something goes wrong (e.g., you never receive your item, or it's not as described), reach out to the baker first. If you're unable to resolve the issue, you can contact Homebaked at support@homebakedapp.com and we'll assist you.

We may offer refunds at our discretion, but we do not guarantee them.

7. Content & Reviews

You may leave reviews or upload content through the platform. By doing so, you grant Homebaked a non-exclusive, royalty-free license to display and use that content (e.g., review text, photos).

We may remove content that is abusive, discriminatory, irrelevant, or violates these Terms.

8. Prohibited Uses

You agree not to:

  • Use Homebaked for illegal purposes,
  • Impersonate others or misrepresent your identity,
  • Attempt to scrape, hack, or disrupt the platform,
  • Harass bakers or other users.

We may suspend or terminate accounts that violate these Terms.

9. Our Role & Liability

Homebaked is not liable for:

  • The quality, safety, legality, or delivery of goods sold on the platform,
  • Any damages resulting from your use of the platform or your interactions with bakers.

We provide the platform as-is without warranties of any kind.

10. Updates & Changes

We may update these Terms from time to time. If we make material changes, we'll let you know (via app notice, email, or both). Continued use of the platform means you accept the new Terms.

11. SMS Program Terms

Program: "Homebaked Transactional Notifications"
Purpose: Transactional updates about your activity (e.g., order alerts, new message notifications, pickup reminders).
Opt-in methods:
  1. In-app toggle: Profile → Edit Profile → "Receive SMS notifications."
  2. Checkout checkbox: "Text me updates about this order."
Consent: By opting in, you authorize Homebaked to send SMS messages to the phone number you provide. Message frequency varies by activity (typically 0–10 msgs/month). Message & data rates may apply.
Opt-out: Reply STOP to end messages at any time. You may also disable SMS in your profile settings.
Help: Reply HELP or email support@homebakedapp.com.
Eligibility: You must provide your own mobile number and have authority to consent. Service availability may vary by carrier and location.
Delivery disclaimer: Carriers are not liable for delayed or undelivered messages.
